Rules that shape AI work in the capital

Federal automated decisions. The Directive on Automated Decision-Making applies to automated decision systems used to make administrative decisions about clients of institutions subject to the Policy on Service and Digital. Before such a system goes into production, the institution completes, approves and publishes an Algorithmic Impact Assessment. The directive sets four impact levels, from Level I (little to no impact) to Level IV (very high impact). Existing systems had until June 24, 2026 to meet the 2025 requirements.

Generative AI in federal teams. The Treasury Board Guide on the use of generative AI asks federal institutions to explore uses of these tools and sets the FASTER principles: Fair, Accountable, Secure, Transparent, Educated and Relevant. We use it as the checklist for any pilot with a federal team.

Two official languages. Under section 22 of the Official Languages Act, federal institutions must let the public communicate and get services in either official language at their offices in the National Capital Region. An AI assistant or drafting workflow for a federal service is designed in both languages from the first prototype.

Ottawa and Gatineau follow different privacy laws. A private business in Ottawa falls under PIPEDA. A private business in Gatineau falls under Quebec's private-sector privacy act, amended by Law 25. Since September 22, 2023 it requires telling a person when a decision about them is made exclusively by automated processing, and a privacy impact assessment before acquiring or overhauling a system that handles personal information.
